We adhere to a stringent policy concerning returns and refunds for all Overberg Medical products and consumables.

1. Warranty of Quality and Replacements

In accordance with s56 (read with s55) of the Consumer Protection Act (CPA), all Overberg Medical goods sold to consumers come with a standard manufacturing warranty, ensuring that:

  • Goods are reasonably suitable for their intended purpose.
  • Goods are of high quality, free of defects, and in optimal working condition.
  • Goods will exhibit durability and usability for a reasonable period.

2. Non-Returnable Items for Safety & Hygiene Reasons

For health and hygiene reasons, the following items cannot be returned once opened or used:

  • CPAP Masks – Due to direct facial contact, masks cannot be returned once unsealed.
  • CPAP Machines – Once used, these devices cannot be returned unless found to be defective within the warranty period.
  • Oxygen Concentrators – For sanitary and medical safety reasons, oxygen concentrators cannot be returned once used.

Exceptions will only be made if the item is found to be faulty upon delivery or if there is a manufacturer defect within the warranty period.

3. When a Product is NOT Considered Defective

A product will not be considered defective, and the customer will not be eligible for replacement, refund, or credit under the general warranty if:

  • The faults or damage result from normal wear and tear.
  • Damage arises from incorrect usage or improper storage of the product.
  • Product performance issues or discrepancies in results stem from user error or failure to follow correct testing procedures.

4. If a Product is Not Defective

  • If the product is determined NOT to be defective and is commercially acceptable, or if user error is identified as the cause of performance discrepancies:
    • You will not be entitled to a repair or replacement.
    • You will be responsible for the costs associated with returning the product to Overberg Medical and the cost of redelivery back to you.

5. Repair, Replacement, or Credit Policy

  • The decision to repair, replace, or credit goods remains at the sole discretion of Overberg Medical.
  • Overberg Medical’s liability is limited to the manufacturing warranty of its products.
  • Please ensure you verify the warranty period of your product upon purchase.
